User Content

You retain all rights to your User Content, but you grant CramSmart a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content for the purpose of operating and improving our Service.

You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not violate the privacy rights, publicity rights, copyright, contractual rights, or any other rights of any person or entity
• Your User Content does not contain material that is false, intentionally misleading, or defamatory
• Your User Content does not contain any material that is unlawful, abusive, malicious, harassing, or otherwise objectionable

We reserve the right to remove any User Content that violates these terms or that we otherwise find objectionable, without prior notice.

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of CramSmart and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of CramSmart.

The AI algorithms, learning methodologies, and proprietary technologies that power our study modes are proprietary to CramSmart and are protected as trade secrets and by copyright law.

Payment Terms

CramSmart offers both free features and premium features that require credits. Credits can be purchased as one-time payments through our platform. By purchasing credits, you agree to pay all fees in accordance with the pricing terms presented to you at the time of purchase.

Credits are non-refundable once they have been used to access premium features or modes. Unused credits remain valid in your account until used, subject to the limitations described below.

When using our credit system:

• Credits are purchased as one-time payments and do not automatically renew
• Credits may expire after 12 months of account inactivity
• Different app modes and features may require different amounts of credits
• We reserve the right to change our credit pricing structure upon reasonable notice
• Special promotions, discounts, and bonus credits may be offered at our discretion

Payment processing is handled by secure third-party payment processors. CramSmart does not store complete credit card information on our servers. By making a purchase, you agree to the terms and conditions of our payment processor as well.

Limitation of Liability

To the maximum extent permitted by law, CramSmart and its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Reliance on information or content provided through the Service
• Academic performance or outcomes resulting from use of the Service

CramSmart is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the operation or availability of the Service.

We do not guarantee that:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The results from using the Service will be accurate or reliable
• Any errors in the Service will be corrected
• The Service will be available at any particular time or location
• Using the Service will lead to specific academic outcomes or improved grades

Educational content and AI-generated explanations are provided for learning assistance purposes only and should not be considered a substitute for formal instruction or professional advice.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms and Conditions.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through your account settings.

All provisions of these Terms and Conditions which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Changes to Terms
